CREATIVE GREEN TOOLS TERMS OF USE

The Centre for Sustainable Practice in the Arts (“CSPA”, “we”, “us” or “our”) licences and operates certain carbon calculation tools specifically designed for use in the arts and culture sector (the “Website”) which are accessible at https://canada.ig-tools.com.

We are committed to maintaining the accuracy, confidentiality, and security of your personal information. This Privacy Policy describes the personal information we collect, use, and disclose when you use the Website. The purpose of this Privacy Policy is to help you understand what types of information we collect and what may happen to that information when you use the Website.

By accessing or using the Website, you agree to accept this Privacy Policy, including the terms and conditions of this Privacy Policy that relate to the ways that we collect, use, disclose and otherwise process your personal information. You can withdraw your consent at any time by contacting our Privacy Officer using the contact information that is provided in this Privacy Policy below. Please note that if you choose to withdraw your consent, we may not be able to provide you with access to or use of the Website.

  • personal information that is contained in any Feedback (as defined in the Terms) that you provide to us;
  • information that you provide by filling in forms and data fields on our site www.canada.ig-tools.com. This includes information provided at the time of registering to use our site, data inputted when using the Creative Green Tools carbon calculators, posting material and uploading files, or requesting further services.
  • other personal information that you choose to provide to us when you report a problem with the Website;
  • if you contact us at support@cgtoolscanada.org, soutien@cgtoolscanada.org, info@cgtoolscanada.org or through our contact form at https://www.cgtoolscanada.org/contact, we may keep a record of that correspondence;
  • any other information that you choose to send us either through the Creative Green Tools, support@cgtoolscanada.org, soutien@cgtoolscanada.org, info@cgtoolscanada.org or our contact form at https://www.cgtoolscanada.org/contact. We may also receive your personal information from a third party. We will make reasonable efforts to ensure that any third party that provides us with your personal information has obtained your permission to disclose your personal information to us (such permission may be given directly by you or implied from your actions).

We only collect personal information to provide you with the functionality and services available through the Website and to enable us to manage, maintain, and develop our operations. For example, we collect personal information in order to:

  • carry out our obligations arising from our contracts with our arts council reporting partners to provide environmental resources to all major revenue funded program organizations;
  • carry out our obligations arising from any contracts entered into between third party contractors in relation to provision of services to you; and

Like other online tools and websites, we may also use passive tracking technologies and third-party analytics to collect information from you. Provided you have activated some of them, these tools may automatically monitor and track information related to activities on our Website, including the Internet Protocol (IP) address of your computer, the IP address of your Internet Service provider, the date and time you access our Website, the Internet address of the website from which you linked directly to our Website, the operating system you are using, the pages of our Website you visit, the pages you read and the images you viewed on our Website, and the content you download from our Website.

Marketing Communications

By using and accessing the Creative Green Tools, you agree to receive transactional communications about your account and activities on or in connection with the Creative Green Tools or our Website. For example, when you create an account, reset your password, or submit a technical question to us you will receive an email confirming your account details.

How Is Your Personal Information Protected and Held?

CSPA takes reasonable physical, technical, and organizational measures to protect the personal information we hold about you safe from loss, unauthorized access, modification, or disclosure. Centre for Sustainable Practice in the Arts and Réseau des femmes en environment will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy with standards and protections in place that are no less stringent than our own.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use commercially reasonable procedures and security features to prevent unauthorized access, use, or disclosure of your personal information in accordance with applicable laws.

When Will We Disclose Your Personal Information?

Our Affiliates, Employees, Staff, and Service Providers

We may disclose your personal information to our affiliates, including Réseau des femmes en environment who operates the French language version of the Creative Green Tools and our respective employees, arts councils from whom you receive funding and with whom you are enrolled in a reporting program, contractors, consultants, services providers and other parties who require such information to assist us with managing our relationship with you.
If you have given us your name as part of the contact information that you have provided with respect to your organization or business, then we may disclose your name to our arts council partners in connection with the environmental data that you have entered into the Creative Green Tools to identify you as part of those partners’ reporting portfolio(s).

Business Transactions

Personal information may also be disclosed or transferred to another party during the course of, or upon completion of, a change in ownership of, or the grant of a security interest in, all or a part of CSPA or its affiliates through, for example, an asset or share sale, or some other form of business combination, merger or joint venture, provided that such party is bound by appropriate agreements or obligations and required to use or disclose your personal information in a manner consistent with the use and disclosure provisions of this privacy policy, unless you consent otherwise.

Other General Disclosures

We may disclose your personal information to third parties:
- as permitted or required by applicable law or regulatory requirements;
- to comply with valid legal processes such as search warrants, subpoenas or court orders;
- as part of our regular reporting activities under applicable law to protect the rights and property of Julie’s Bicycle Limited, the CSPA, the Réseau des femmes en environment, our customers, or others;
- during emergency situations or where necessary to protect the safety of a person or group of persons; and
- for any additional purposes for which we have obtained your consent to disclose your personal information.

Your Consent to our Transfer of Your Personal Information Across Borders

The personal information that we collect from you may be transferred to, and stored at, a destination outside of your Canadian province or territory or outside Canada, including in the United Kingdom. It may also be collected, used, disclosed, and otherwise processed by our staff operating outside of your Canadian province or territory or outside of Canada, who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of support services, or the maintenance and update of the Creative Green Tools and our Website. Obtaining Consent

Access To Your Personal Information

You can ask to access the personal information that we have received from or possess about you. If you want to review, verify, delete, or correct your personal information, please contact our Privacy Officer.

You may request that computerized personal information be communicated in the form of a written and intelligible transcript.

As of September 22, 2024, unless doing so raises serious practical difficulties, you may request that computerized personal information collected from you, and not created or inferred using personal information concerning you, be communicated to you in a structured, commonly used technological format. The information will also be communicated, at your request, to any person or body authorized by law to collect such information.

When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. If you require assistance in preparing your request, please contact our Privacy Officer. Please note: if your request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover our administrative costs.

Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices. In the event that we cannot provide you with access to your personal information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.

Children.

The Creative Green Tools are not directed to children, and we do not knowingly collect, use, or disclose personal information from children through the Creative Green Tools, except where such disclosure is done in compliance with applicable laws.

Changes to Our Privacy Policy

The CSPA may make changes to this privacy policy from time to time to reflect changes in its legal or regulatory obligations or in the manner in which we deal with your personal information. Any changes we may make to our privacy policy in the future will be posted on this page.
If we make any material changes, we will notify you as required by law, but we encourage you to check back often for updates. Your continued use of the Creative Green Tools after an update to this privacy policy means that you consent to the collection, use, and disclosure of your personal information as described in the updated Privacy Policy.
